General Terms — Coup de Foudre Offer

In these Terms, the following expressions have the meanings set out below:

• "Offer": the "Coup de Foudre" promotional offer described herein.
• "Holder": the individual who made the booking and accepted these Terms.
• "Session": the filming time slot booked in one of the Provider's studios.
• "Coup de Foudre Rate": the preferential rate applicable under the Offer.
• "Standard Rate": the standard rate in effect at the time of the service, excluding any promotion.
• "Provider": CreativGen / Fantasmagorie Agency.

The Coup de Foudre Offer is reserved for individuals of legal age (or minors with written parental consent) who complete their first booking before March 31, 2026 at 11:59 PM (Paris time), inclusive. It is strictly personal and non-transferable. The Provider reserves the right to refuse any booking that does not meet the eligibility requirements.

The Offer must be activated through a confirmed and paid booking (deposit or full amount) before March 31, 2026 at 11:59 PM (Paris time). After this date and time, the Offer will no longer be available, without exception or possible extension. The filming Session may take place at a later date, within a maximum period of twelve (12) months following the booking date. Beyond this period, the Coup de Foudre Rate will automatically be replaced by the Standard Rate in effect at the time of the Session.

The booking is confirmed only upon full payment of the total Session amount, due at the time of booking. No booking will be validated without complete payment. All payments made are final and non-refundable, except in cases expressly provided for in these Terms (valid rescheduling or force majeure). Payments are made by credit card through the secure Stripe platform. No cash, bank transfer, or check payments are accepted.

The Offer is strictly attached to the Holder who made the original booking. It may under no circumstances be assigned, resold, transferred, lent, or used by a third party, including a colleague, partner, spouse, or family member. Any direct or indirect attempt to transfer the Offer results automatically and without prior notice in the permanent and irreversible loss of the Coup de Foudre Rate. The Session will then be billed at the current Standard Rate.

The Coup de Foudre Offer cannot be combined with any other promotional offer, discount code, loyalty program, commercial rebate, or current or future benefit offered by the Provider, unless expressly stated otherwise in writing. If a combination is detected, only the most advantageous offer for the Holder will be applied.

The individual physically present at the Session must be the Holder of the account who made the booking. The Provider reserves the right to verify the Holder's identity upon arrival by requesting a valid official identification document (national ID card, passport, or residence permit). In case of discrepancy between the Holder's identity and the person present, the Provider reserves the right to refuse studio access or to bill the Session at the current Standard Rate, without any possible recourse.

The Holder agrees to:

• Arrive at the agreed time for the Session. Any delay exceeding fifteen (15) minutes without prior notification may result in a proportional reduction of the Session duration, without compensation or refund.
• Comply with the studio house rules, displayed on-site and available on the website creativgen.com (view the house rules).
• Use the equipment and facilities provided with care and in accordance with their intended purpose. Any damage to equipment, facilities, or premises caused by the Holder or their guests will be billed at replacement or repair cost.
• Not bring illegal substances, hazardous materials, or animals into the premises (unless with prior written consent from the Provider).
• Inform the Provider of any particular situation (disability, specific needs) to ensure the smooth running of the Session.

In case of an unreported absence by the Holder (no-show), the full Session amount will be due and no refund will be issued. The Coup de Foudre Rate will be maintained for future Sessions only if the Holder notifies the Provider within twenty-four (24) hours following the missed time slot. Failing this, the Provider reserves the right to terminate the benefit of the Offer.

Content produced during the Session (videos, photographs, audio recordings) is the property of the Holder, subject to the Provider's intellectual property rights over its methods, know-how, set designs, software, and tools used during the Session.

By accepting these Terms, the Holder grants the Provider a non-exclusive, royalty-free, worldwide license for a period of five (5) years to use the visual content produced during the Session (excerpts, images, behind-the-scenes) for communication, promotional, and portfolio purposes, on its website, social media, and any promotional material. This authorization may be withdrawn by the Holder at any time by written notification to hello@creativgen.com, with an implementation period of thirty (30) business days. Withdrawal applies only to future uses and shall not give rise to any compensation. Withdrawal of this authorization does not result in the loss of the Offer benefit.

The Provider undertakes never to use the Holder's content in a disparaging, defamatory context or in any way that damages the Holder's image.

The Coup de Foudre Rate of €225 excl. tax/h (i.e., €210 incl. tax/h at the current VAT rate of 20%) covers exclusively the provision of the studio and an operator's services for the duration of the booked Session. The following are billed separately at the current Standard Rate: Signature set design, additional equipment rental, extra hours beyond the initial booking, and any service not expressly mentioned in the Offer description.

The filming + editing option at €283,33 excl. tax/h (i.e., €340 incl. tax/h) benefits from a promotional rate valid only for Sessions booked before March 31, 2026. After this date, editing will be billed at the current Standard Rate, without exception. Listed rates are subject to change in accordance with legislative amendments relating to VAT.

Sessions may be rescheduled free of charge up to forty-eight (48) hours before the booked time slot, by written notification (email to hello@creativgen.com). Within this period:

• Cancellation between 48h and 24h before the Session: 30% cancellation fee of the Session amount.
• Cancellation less than 24h before the Session: 50% cancellation fee of the Session amount.
• Same-day cancellation or no-show: 100% of the Session amount is due.

The Coup de Foudre Rate is maintained in case of a valid rescheduling (within the 48h notice period). The number of reschedulings is limited to two (2) per Session. Beyond this, the Provider reserves the right to bill the Session at the Standard Rate.

The Provider uses all reasonable means to ensure the smooth running of Sessions. However, the Provider shall not be held liable in case of:

• Technical failure or equipment malfunction beyond its control, subject to offering a free rescheduling.
• Indirect damages, loss of profits, data loss, or intangible harm of any nature.
• Non-compliance by the Holder with their obligations under these Terms.

In any event, the Provider's total liability under these Terms is limited to the amount actually paid by the Holder for the Session in question. This limitation does not apply in cases of gross negligence or willful misconduct by the Provider, nor in cases of personal injury.

The Provider reserves the right to suspend or permanently terminate the benefit of the Coup de Foudre Rate, without notice or compensation, in the following cases:

• Force majeure within the meaning of Article 1218 of the French Civil Code (permanent closure, construction rendering the studio inaccessible, disaster, natural catastrophe, pandemic, administrative or governmental decision).
• Abusive or fraudulent use of the Offer: resale of time slots, commercial use on behalf of third parties, false declarations, disrespectful or threatening behavior toward staff.
• Non-compliance with these Terms by the Holder.

In case of force majeure rendering the Session impossible, the Provider will offer the Holder, depending on the circumstances, a rescheduling or a full refund of amounts paid, excluding any other compensation.

Personal data collected under the Offer (surname, first name, email address, phone number, payment data) is processed by the Provider as data controller, in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and the French Data Protection Act of January 6, 1978, as amended.

This data is collected for the purposes of booking management, service delivery, billing, and commercial communications (subject to the Holder's consent). It is retained for the duration of the contractual relationship, plus applicable legal limitation periods.

The Holder has the right to access, rectify, delete, and port their data, as well as the right to object to and restrict processing. These rights may be exercised by email at hello@creativgen.com. In case of a complaint, the Holder may contact the French Data Protection Authority (CNIL).

The Provider reserves the right to amend these Terms at any time. Amendments shall take effect from their publication on the Provider's website. Bookings confirmed and paid before the amendment date remain subject to the Terms in effect at the time of their validation. The Holder will be informed of any material amendment by email to the address provided at the time of booking.

If any provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions shall retain their full force and effect. The invalidated clause shall be replaced by a valid clause that most closely reflects the parties' original intent.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, in case of a dispute not resolved amicably, the Holder may refer free of charge to the mediation service designated by the Provider. The mediator's contact details are available upon request at hello@creativgen.com and on the Provider's website. The Holder may also file a complaint on the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

These Terms are governed by French law. In case of a dispute and after failure of any attempt at amicable resolution or mediation, the competent courts within the jurisdiction of the Paris Judicial Court shall have sole jurisdiction, subject to the mandatory provisions of the French Consumer Code regarding territorial jurisdiction.

The Holder declares having read these Terms in their entirety before making their booking and accepts them without reservation. Acceptance of these Terms is evidenced by the checkbox during the online booking process. These Terms are archived and accessible at any time on the Provider's website.
